Why China?

China is now the third-largest buyer of US exports. The US exported $85.4 billion to China and Hong Kong in 2007. China is the fastest growing of the United States major export markets. The US exports to China grew about 18% in 2007 and 301% since 2000.

China is also the second largest seller and buyer of gold and automobiles in the world and ranks third in consumption of health care supplies and luxury items. In fact, China is expected to top the global luxury market by 2014, with a market share of 23%.

For the past 5 years, Chinas annual consumption growth rate was at 13% and it is estimated that if growth continues at just 10%, Chinas consumer market scale will exceed RMB 30 trillion by 2020.

How can you protect your Intellectual Property in China?

To minimize our clients risk on IP issue, we always suggest to our clients:

1. File for patents in China. If you file a patent application in any PCT country then within one year either 1 ) file in China or 2) file a PCT application and then file in China within 30 months, you can potentially end up with patent coverage for China. Not only is the timeline not extendable, however, the first patent filing in a PCT country needs to be done before any offer for sale, sale, publication or disclosure anywhere in the world or all rights can be permanently lost in China. Its best to consult an IP expert before proceeding.

2. Select a Chinese manufacturer with a good reputation. This is the most important factor in minimizing the risk of generating counterfeit products. We cover this item for you. We assist our clients in selection of manufacturing partners with good reputations and established track records demonstrating quality manufacturing, record keeping, and respect for intellectual property.

3. Use more than one manufacturer to produce bulk parts and components, and to use a separate manufacturer to do the assembly and packaging. This, of course, is based on a company's business needs and product.
